Terms of Service

These Terms of Service ("Terms") govern your access to and use of Fish Analysis (the "App"), an Android application operated by DucDA ("we", "us", or "our").

By downloading, installing, accessing, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

Fish Analysis provides tools that may allow you to:

• Sign in with TikTok (Login Kit) to authorize read-only access to your account data;
• View statistics for your own public videos and account (for example views, likes, comments, shares, follower-related stats available through TikTok APIs);
• Optionally connect other platforms (such as Facebook/Meta) for similar read-only insights when enabled;
• Request AI-generated feedback (via Google Gemini or similar) about content performance based on metrics you choose to analyze.

The App is designed for your own authorized accounts. It is not a tool to scrape, monitor, or harvest data from accounts you do not control or have not authorized.

You must be at least 13 years old (or the minimum age required to use TikTok / applicable platforms in your country) and able to form a binding contract. You are responsible for complying with TikTok, Meta, Google, and local laws when using the App.

To use analytics features, you may need to authorize the App through TikTok and/or Meta OAuth. You must only connect accounts you own or are legally authorized to manage.

You agree to:

• Keep your device and platform credentials secure;
• Revoke App access in TikTok/Meta settings if you no longer wish to use the integration;
• Not share access tokens or attempt to bypass platform security controls.

We may suspend or terminate access if we reasonably believe you violated these Terms or platform policies.

TikTok features rely on products such as Login Kit and TikTok API (Display API) and scopes including (as configured) user.info.basic, user.info.stats, and video.list.

Unless we clearly request and you approve additional permissions, the App uses TikTok access for read-only display of your profile and public video metrics. We do not claim ownership of your TikTok content.

Your relationship with TikTok is governed by TikTok's Terms of Service and Developer Terms. If TikTok changes, limits, or revokes API access, related App features may stop working without liability on our part.

AI insights are optional and informational only. Outputs from Gemini or similar models may be incomplete, inaccurate, or unsuitable for your situation. You remain solely responsible for creative, business, and publishing decisions.

Do not submit unlawful content or personal data of others into analysis prompts beyond what is necessary and authorized.

You agree not to:

• Use the App for any illegal purpose or in violation of TikTok/Meta/Google policies;
• Attempt unauthorized access to other users' data or our systems;
• Reverse engineer, abuse rate limits, or interfere with the App or third-party APIs;
• Misrepresent the App's relationship with TikTok, Meta, or Google;
• Use the App to spam, harass, or infringe intellectual property rights.

The App, including its design, code, branding, and documentation (excluding your social content and third-party trademarks), is owned by DucDA or its licensors. TikTok, Facebook, Meta, Google, and Gemini names and logos are property of their respective owners.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that metrics are complete, real-time, or identical to what you see inside native TikTok or Facebook apps. Platform APIs may omit fields (for example certain reach or watch-time metrics) or delay updates.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUCDA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE APP OR RELIANCE ON AI OUTPUTS OR STATISTICS.

Our total liability for any claim relating to the App shall not exceed the greater of (a) the amount you paid us for the App in the 12 months before the claim, or (b) USD 50, if the App is provided free of charge.

You agree to indemnify and hold harmless DucDA from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the App, your content, or your violation of these Terms or third-party platform rules.

We may modify these Terms or the App features at any time. Material changes will be reflected by updating the "Last updated" date and, where appropriate, notice in the App or on https://ducda.dev/terms. Continued use after changes constitutes acceptance.

We may suspend or discontinue the App or integrations without notice if required by platform policy, security risk, or operational reasons. You may stop using the App at any time and revoke third-party authorizations.

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law principles, unless mandatory consumer protections in your country provide otherwise. Courts in Vietnam shall have jurisdiction over disputes, subject to applicable mandatory rights.
